FKB's Mike Furman and Melissa Manning obtain a unanimous defense verdict in Richmond County Supreme Court, dismissing lawyers professional malpractice claims against a well-known plaintiff's personal injury law firm.4/16/10

FKB's client, a well-known plaintiff's personal injury law firm based in Nassau County, represented the plaintiff, a young union millwright, in an underlying personal injury action which arose from a construction accident which allegedly resulted in significant personal injuries, including cervical spinal fusion surgery (C 4-5), and shoulder joint reconstruction (anterior cervical decompression and fusion of C 4-5, and correction of a posterior labral tear in the right shoulder). The plaintiff claimed that FKB's client settled the underlying personal injury action at a mediation without his authority for $800,000. Plaintiff claimed that his physical injuries, lost wages and other damages were worth considerably more, and sued FKB's client for legal malpractice in settling the underlying personal injury action without his authority and for an unreasonable sum, seeking damages in excess of $3 million.

The action was tried before Hon. Joseph J. Maltese, J.S.C. in Richmond County Supreme Court, and a unanimous jury returned a defense verdict in favor of FKB's client.
