As set forth in the attached Order, Certain Underwriters at Lloyd's of London have entered into a settlement agreement with the WTC Captive Insurance Company, Inc., and numerous plaintiffs with alleged marine-based debris exposure, allegedly arising out of the extensive cleanup efforts following the 9/11 attacks. FKB's Michael Furman, Andrew Jones, and Andrew Kowlowitz, assisted by Joshua Abrams, Florence Lishansky, and Steven Hansen represent Lloyd's, which insured the City of New York in connection with certain clean-up activities occurring at various piers and barges throughout New York City and the surrounding area, pursuant to the terms and conditions of the polices.
Pursuant to the Settlement Agreement, Lloyd's has agreed to pay $27.5 million to settle claims of those plaintiffs who sued the City and Weeks Marine, Inc., for injuries they allegedly sustained during the rescue, recovery and debris removal operations following the terrorist attacks of 9/11. This compensation is only for those plaintiffs who alleged a marine exposure and follows a separate agreement that the plaintiffs reached with the City of New York, worth up to $712.5 million.
