Furman Kornfeld & Brennan's Patrick J. Brennan and Jennifer Gutterman successfully defended a client accused of improper technique in a phlebotomy procedure that plaintiffs alleged caused Reflex Sympathetic Dystrophy/Complex Regional Pain Syndrome (RSD/CRPS).

The plaintiff, age 43, sought medical treatment the day following the procedure for shooting, searing pains down her arm, numbness, tingling and inability to move her fingers, and had four surgical procedures to alleviate her intractable pain including radio-frequency ablations in her cervical spine and placement of a permanent dorsal spine stimulator.

The jury in the United States District Court, Southern District of New York returned a unanimous verdict in less than one hour finding no liability. Judge Cathy Seibel presided over the trial. FKB's medical malpractice team has considerable experience in defending RSD/CRPS cases, which require a directed defense strategy from the outset of litigation.
